Article 1 - Definitions
In these terms and conditions, the following definitions apply:
- Additional Agreement: an agreement whereby the consumer acquires products, digital content, and/or services in connection with a distance agreement, and these products, digital content, and/or services are provided by Bring Back Culture or a third party based on an arrangement between that third party and Bring Back Culture.
- Reflection Period: the period during which the consumer can exercise their right of withdrawal.
- Consumer: a natural person who does not act for purposes related to their trade, business, craft, or profession.
- Day: calendar day.
- Digital Content: data that is produced and delivered in digital form.
- Duration Agreement: an agreement aimed at the regular delivery of goods, services, and/or digital content over a specified period.
- Durable Medium: any tool, including email, that allows the consumer or entrepreneur to store information that is personally addressed to them in a manner that is accessible for future consultation or use over a period suitable for the purpose for which the information is intended, allowing for unchanged reproduction of the stored information.
- Right of Withdrawal: the possibility for the consumer to withdraw from the distance agreement within the reflection period.
- Distance Agreement: an agreement concluded between Bring Back Culture and the consumer as part of a organized system for the sale of products, digital content, and/or services at a distance, whereby, up until the conclusion of the agreement, use is made exclusively or partly of one or more techniques for remote communication.
- Model Withdrawal Form: the European model withdrawal form included in Annex I of these terms and conditions.
- Bring Back Culture: the legal entity as defined in Article 2, which offers products, (access to) digital content, and/or services at a distance to consumers as outlined in these general terms and conditions.
- Remote Communication Technique: a means that can be used for concluding an agreement, without the consumer and entrepreneur having to come together in the same location simultaneously.

Article 3 - Applicability
These general terms and conditions apply to every offer from Bring Back Culture and to every distance agreement concluded between the entrepreneur and the consumer.
Before the distance agreement is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, Bring Back Culture will indicate how the general terms and conditions can be viewed and that they will be sent free of charge upon request by the consumer as soon as possible.
If the distance agreement is concluded electronically, the text of these general terms and conditions may be made available to the consumer electronically in such a way that it can be stored by the consumer on a durable medium. If this is not reasonably possible, it will be indicated where the general terms and conditions can be reviewed electronically and that they will be sent to the consumer free of charge electronically or otherwise upon request.
In cases where specific product or service terms also apply in addition to these general terms and conditions, the second and third paragraphs will apply accordingly, and the consumer may always invoke the provision that is most favorable to them in the case of conflicting terms.
Article 4 - The Offer
If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.
The offer contains a complete and accurate description of the offered products, digital content, and/or services. The description is detailed enough to allow the consumer to make a proper assessment of the offer. If Bring Back Culture uses images, these are a true representation of the offered products, services, and/or digital content. Obvious mistakes or errors in the offer do not bind Bring Back Culture.
Every offer contains sufficient information to make it clear to the consumer what rights and obligations are associated with the acceptance of the offer.
Article 5 - The Agreement
The agreement is concluded at the moment the consumer accepts the offer and meets the associated conditions, subject to the provisions in paragraph 4.
If the consumer has accepted the offer electronically, Bring Back Culture will confirm receipt of this acceptance electronically without delay. Until this confirmation has been received by the consumer, they can dissolve the agreement. After receipt of this confirmation, it is no longer possible for the consumer to dissolve or cancel the agreement; however, the consumer can exercise the right of withdrawal (Article 6).
If the agreement is concluded electronically, Bring Back Culture will take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a safe web environment. If the consumer can pay electronically, Bring Back Culture will take appropriate security measures for this.
Bring Back Culture may inform itself—within legal frameworks—whether the consumer can meet their payment obligations and about all facts and factors that are important for a responsible conclusion of the distance agreement. If, based on this investigation, Bring Back Culture has good reasons not to enter into the agreement, they are entitled to refuse an order or request with justification or to attach special conditions to the execution.
Bring Back Culture will provide the following information, in writing or in such a way that it can be stored by the consumer on a durable medium, at the latest when delivering the product, service, or digital content:
- the visiting address of Bring Back Culture's establishment where the consumer can address complaints;
- the conditions under which and the manner in which the consumer can exercise the right of withdrawal, or a clear statement regarding the exclusion of the right of withdrawal;
- information about warranties and existing after-sales service;
- the price, including all taxes, of the product, service, or digital content; if applicable, the costs of delivery; and the manner of payment, delivery, or execution of the distance agreement;
- the requirements for terminating the agreement if it has a duration of more than one year or is of indefinite duration;
- if the consumer has a right of withdrawal, the model withdrawal form. In the case of a duration transaction, the provision in the previous paragraph applies only to the first delivery.
Article 6 - Right of Withdrawal
The consumer can dissolve an agreement related to the purchase of a product within a reflection period of at least 14 (fourteen) days without providing any reasons. Bring Back Culture may ask the consumer for the reason for withdrawal, but they cannot be obliged to provide their reason(s).
The reflection period mentioned in paragraph 1 starts on the day after the consumer, or a third party designated by the consumer who is not the carrier, has received the product, or:
- if the consumer has ordered multiple products in the same order: the day on which the consumer, or a designated third party, has received the last product. Bring Back Culture may refuse an order of multiple products with different delivery times, provided they have informed the consumer of this clearly prior to the ordering process.
- if the delivery of a product consists of different shipments or parts: the day on which the consumer, or a designated third party, has received the last shipment or part;
- for agreements for the regular delivery of products over a specified period: the day on which the consumer, or a designated third party, has received the first product.
In the case of services and digital content that is not delivered on a tangible medium: The consumer can dissolve a service agreement and an agreement for the delivery of digital content that is not delivered on a tangible medium for at least 14 days without providing reasons. Bring Back Culture may ask the consumer for the reason for withdrawal, but they cannot be obliged to provide their reason(s).
The reflection period mentioned in paragraph 3 starts on the day following the conclusion of the agreement.
Extended Reflection Period for Products, Services, and Digital Content Not Delivered on a Tangible Medium if the Right of Withdrawal is Not Communicated
If Bring Back Culture has not provided the consumer with the legally required information about the right of withdrawal or the model withdrawal form, the reflection period extends until twelve months after the end of the original reflection period established in accordance with the previous paragraphs of this article.
If Bring Back Culture provides the information referred to in the previous paragraph to the consumer within twelve months after the start of the original reflection period, the reflection period expires 14 days after the day on which the consumer received that information.
Article 7 - Obligations of the Consumer During the Reflection Period
During the reflection period, the consumer will handle the product and packaging with care. They will only unpack or use the product to the extent necessary to ascertain the nature, characteristics, and functioning of the product. The principle here is that the consumer may only handle and inspect the product as they would be allowed to do in a physical store.
The consumer is liable for any diminished value of the product that results from handling the product beyond what is permitted in paragraph 1.
Article 8 - Exercising the Right of Withdrawal by the Consumer and Associated Costs
If the consumer exercises the right of withdrawal, they must notify Bring Back Culture of this by means of the model withdrawal form or any other unambiguous statement.
The consumer will return the product as soon as possible, but within 14 days following the withdrawal, and they will do so in the original condition and packaging, if reasonably possible. The consumer is responsible for the direct costs of returning the product. If Bring Back Culture has not indicated that the consumer must bear these costs or has not informed the consumer that they would bear the costs, the consumer does not have to bear the costs of return.
If the consumer withdraws after first having expressly requested that the provision of the service or delivery of gas, water, or electricity be commenced during the reflection period, the consumer is obliged to pay Bring Back Culture a reasonable amount for the part of the service that has been provided until the moment of withdrawal.
The consumer cannot be held responsible for any diminished value of the product if Bring Back Culture has not provided them with the legally required information about the right of withdrawal.
Article 9 - Obligations of Bring Back Culture in Case of Withdrawal
If Bring Back Culture allows the consumer to withdraw, they will refund all payments made by the consumer, including any delivery costs charged by Bring Back Culture for the returned product, without delay but within 14 days following the day on which the consumer has communicated the withdrawal.
Unless Bring Back Culture offers to collect the product themselves, they may wait to refund until they have received the product or until the consumer demonstrates that they have returned the product, whichever comes first.
Refunds will be made using the same payment method used by the consumer, unless the consumer agrees to a different method. The consumer will not incur any fees for such reimbursement.
Article 10 - Exclusion of the Right of Withdrawal
The following products and services are excluded from the right of withdrawal:
- Products that have been created by Bring Back Culture according to consumer specifications, including but not limited to tailored items.
- Products that are clearly personal in nature.
- Products that cannot be returned for health protection or hygiene reasons and whose seal has been broken after delivery.
- Products that, due to their nature, cannot be returned (for example, digital content).
- Agreements that relate to accommodation, transport, catering, or leisure activities to be carried out on a specific date or during a specific period.
Article 11 - The Price
During the validity period stated in the offer, the prices of the offered products, digital content, and/or services will not be increased, except for price changes resulting from changes in VAT rates.
In deviation from the previous paragraph, Bring Back Culture may offer products or services whose prices are subject to fluctuations in the financial market and whose prices are not set by Bring Back Culture. The offer will state that the prices are subject to fluctuations and that the prices may vary.
Price increases within 3 months after the conclusion of the agreement are only allowed if they result from statutory regulations.
Price increases from 3 months after the conclusion of the agreement are only allowed if Bring Back Culture has stipulated this and:
- They are the result of statutory regulations or provisions;
- The consumer has the right to terminate the agreement on the day of the price increase.
Article 12 - Fulfillment and Additional Warranty
Bring Back Culture guarantees that the products and services meet the agreement, the specifications stated in the offer, the reasonable requirements of reliability and usability, and the legal provisions and/or government regulations that exist on the date of the conclusion of the agreement. If agreed, Bring Back Culture also guarantees that the product is suitable for other than normal use.
An additional warranty provided by Bring Back Culture, its suppliers, manufacturers, or importers does not affect the legal rights and claims that the consumer can enforce against Bring Back Culture based on the agreement if Bring Back Culture has failed to fulfill its part of the agreement.
Article 13 - Delivery and Execution
Bring Back Culture will take the greatest possible care when receiving and executing orders for products and when assessing requests for the provision of services.
The place of delivery is the address that the consumer has made known to Bring Back Culture.
With due observance of what is stated in Article 6 of these general terms and conditions, Bring Back Culture will execute accepted orders with convenient speed but at the latest within 30 days, unless a longer delivery period has been agreed. If the delivery is delayed, or if an order cannot or can only partially be executed, the consumer will receive notification within 30 days after placing the order. The consumer in that case has the right to terminate the agreement without penalty and is entitled to any compensation.
In the event of dissolution in accordance with the previous paragraph, Bring Back Culture will refund the consumer as soon as possible, but at the latest within 14 days after dissolution, any payments made by the consumer.
The risk of damage and/or loss of products rests with Bring Back Culture until the moment of delivery to the consumer or a previously designated representative and made known to Bring Back Culture, unless expressly agreed otherwise.
Article 14 - Duration Transactions: Duration, Termination, and Renewal
Termination of an agreement for an indefinite period:
The consumer can terminate the agreement, which is concluded for an indefinite period and relates to the regular delivery of products (including electricity) or services, at any time, observing the agreed cancellation rules and a notice period of at least one month.
Termination of an agreement for a fixed duration:
The consumer can terminate the agreement that is concluded for a fixed duration, but only at the end of the term and only in accordance with the agreed cancellation rules and a notice period of at least one month.
If the consumer wishes to terminate an agreement with a fixed duration that extends to more than one year, they may terminate at any time after one year with due observance of the agreed cancellation rules and a notice period of at least one month.
Renewal:
An agreement concluded for a fixed duration will not be automatically renewed or renewed for a specific period unless the consumer is notified in advance of the renewal and its terms in a clear and comprehensible manner.
Article 15 - Payment
The consumer must pay the amounts due within 14 days after the start of the reflection period, or within 14 days after concluding the agreement, depending on which period applies.
The consumer has the duty to immediately report inaccuracies in provided or stated payment details to Bring Back Culture.
If the consumer fails to fulfill their payment obligation(s) in good time, they will be charged with statutory interest after the due date, and Bring Back Culture will have the right to charge the consumer for any reasonable costs incurred in obtaining payment, provided the consumer has been notified of these costs in advance.
Article 16 - Complaint Procedure
Bring Back Culture has a sufficiently publicized complaints procedure and handles complaints in accordance with this complaints procedure.
Complaints about the performance of the agreement must be submitted to Bring Back Culture within a reasonable time, fully and clearly described, after the consumer has discovered the defects.
Complaints submitted to Bring Back Culture will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, Bring Back Culture will respond within the period of 14 days with a confirmation of receipt and an indication of when the consumer can expect a more detailed response.
Article 17 - Disputes
Agreements between Bring Back Culture and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law.
The Consumer must first submit their complaint to Bring Back Culture before they can take the matter to court.
Article 18 - Additional or Deviating Provisions
Additional or deviating provisions from these general terms and conditions may not be to the detriment of the consumer and must be recorded in writing or in such a way that they can be stored by the consumer in an accessible manner.
